Find a Great Drunk Driving Attorney Close to You

If you or someone close to you is facing the very serious charges of drinking and driving, innocent or not, it is imperative to find an experienced drunk driving attorney. You want to look for someone competent and ethical in their representation and avoid the alternatives at all costs. Although legal fees can be very steep, there are effective ways to find help these days for people of all income levels.

·         The best source to find drunk driving lawyers is almost always through a personal referral. If you know anyone who has faced similar charges then ask them for direction.
·         You can ask a bailiff or a court clerk who they think is the best that they've seen?
·         Don't go to the local Bar Association. They will simply refer you to the next attorney in line on a list of members they have.
·         You can also find excellent free counseling about drunk driving laws and how they relate to your case through many legal websites. This can be done through email correspondence, over the phone, or through chat rooms.

Talk to people

Begin by asking family members and friends of possible leads towards an effective law firm that often represents accused drunk drivers. Despite how unique the case you are dealing with might seem to you, drinking and driving arrests are fairly common and many people are facing these charges. It shouldn't be hard to find someone who has knowledge of a good drunk driving attorney.

National College of DUI Defense

If you would prefer to look for a different resource you can head over to the National College for DUI Defense and view their membership list. This is an organization of more than 800 attorneys nationwide that deal with drunk driving defense. Membership does not guarantee competence or ethics, but it is often a good indicator that this lawyer is serious about their profession. The process of becoming part of this list is extremely demanding, and includes an intensive annual 3 day seminar at Harvard Law School. The American Bar Association recognizes it as the only organization to authorize board-certified attorneys as DUI Defense Specialists.

A lawyer who works specifically in DUI cases

Ideally you want a lawyer that works almost exclusively with drinking and driving cases. DUI defense is a highly specialized field of law and if the lawyer works in various other fields they might not be as effective when you trial starts. Ironically a great attorney will never make any promises as to the outcome of the trial. Specifics of a trial are universally unpredictable. Any fees charged by the law firm should be set forth in a written contract and fully explained. These fees can cover anything from an initial retainer to testimonies, blood sample analysis, subpoena costs, and other court fees.

Credentials Please?

When you sit down with a lawyer for consultation don't be afraid to ask for their credentials and a little bit of history about themselves. Check a lawyers rating with the Martindale-Hubbell International Directory of Attorneys. The highest rating possible is A-V. You can also look up reviews online about certain law firms to see if there have been any complaints.

The best website to get started with all of your legal questions is www.legal-yogi.com. They are experts and can introduce you to a legal team local to your area of the country. Call them for free consultation at 1-800-397-1397.

Laws against Drunk Drinking Urge Offenders to Change Habits

Do you remember the days when you were college students drinking and driving? We all have made mistakes behind the wheel, but we also experience the downfall of receiving a DWI citation. If the police catch us, we are responsible for what happens next. You are not the only one to have experienced this kind of issue; with drunk driving attorneys available, you can find someone to work your case.

Understand the Laws of Your State

Each state has a different governing of which offenders receive a certain suspension of their license. If you understand the processes of your state, you can restore your licenses as soon as 10 days* after receiving a suspension from the courts. Most cases are taken to court within its given county a few days after it’s issued. First-time offenders and repeat offenders with high blood alcohol content (BAC) are to receive a mandatory ignition interlock device.

What Happens Next

The ignition interlock are required for drivers to resume driving by blowing into the machine before the car starts. In most cases, offenders must prove hardship in order to have the machine removed and your license restored within the suspension period offered in your state. Laws against drunk driving govern the outcome of an offender's’ case; by choosing experienced drunk driving attorneys to represent you, you can get an answer from the courts in a reasonable time.

Your Rights

A law against drunk driving is enforceable and as a first time offender, you will experience a different level of leniency within the courts. Knowledgeable lawyers can argue that you may have known that drinking while driving was wrong, but there are extenuating circumstances which drivers attempted to make it home on their own. Your rights, per your state, can be exhausted to ensure you receive the best sentence.

Your Lawyer

We are pretty sure questions are racing through your mind of who you should call to take care of this situation. Your local attorneys are the greatest assets in this time of confusion. While local practicing attorneys available through Legal-Yogi.com are available, you can be sure your case has a chance of receiving a suspension that’s reasonable for your situation.

A few questions to ask a prospective lawyer:

1. How many years have you practiced law in my state?
2. Are you familiar with sentencing in my county?
3. Will you be able to help me restore my license during the suspension period?

If you are pleased with the lawyer’s answers, you may have the perfect match to handle your case. Our specialists have undergone years of examining the court systems of thousands of counties while representing over a million of cases.

No matter how deep your case seems at this point, Legal-Yogi.com will have a lawyer available with the knowledge necessary to guide you through the legal processes of your county. Contact our offices to speak with a representative about how our drunk driving attorneys can assist in your case. Call 1-800-397-1755 or fill out an online form for a free consultation.

Repercussions of DWI

Here is the most important of the drunk driving laws: Don’t do it. Short and sweet, simple to comprehend, yet many people commit this irresponsible act every day. They take the lives of others into their hands every time they take to the road after a 4-martini lunch or a night on the town. I get angry when I hear about a young pedestrian who got killed by a drunk driver who missed a stop sign. I’m also deeply disappointed in the people who get drunk and drive. I wish they’d think more about what they’re doing. I wish they’d care. They have to know it’s against the law, but apparently they aren’t too concerned about that. You’d think that community response would have some effect on them, but I guess not, because they just keep repeating the behavior. Most offenders have already done it three times before they finally get caught.  I just think of the families, including mine, that have to live with the consequences of the havoc these drunk drivers cause, including

• Permanent injury to themselves
• Life-altering physical damage to others
• Death of an innocent bystander
• Property damage

My family lost a son, a brother, and a friend many years ago to the actions of a teenager who was driving home from a party after drinking too much beer. She ran a red light, jumped a curb at high speed, and crashed into our house. My brother was in the living room watching TV at the time and the entire corner of the house just crashed in on him, basically squeezing the life out of him. To say we were devastated is not even close to how we felt. That’s why underage drunk driving is a pet peeve of mine now, as an adult. I cannot condone the actions of people who supply alcohol to teens. Some of the people who do so are parents, older siblings, and legal aged friends. It just blows my mind that they think it’s somehow amusing to see teenagers behaving like idiots because they’re drunk.

There’s this great website, legal-yogi.com, that serves as a consumer resource site. They have a database of over 260,000 financial experts and lawyers and are well-established. They have been very helpful to me with how to deal with people who persist in driving while drunk. If you’re interested in finding answers to any legal issue, the place to go is legal-yogi. Call their toll free number, 800-397-YOGI (1755) for your free initial consultation.  I’m sure they’ll be able to help you.

Become Informed about Drunk Driving Laws in Your State

While under age drunk driving is a serious problem it should not undermine the severity of drunk driving as a whole. Drivers on an overall scale need to learn the importance of avoid drinking and driving because they just don’t mix well together, and just like Hurricane Sandy the combination can cause widespread devastation.

Recognizing Your Limits

One of the most important things drivers need to learn is recognizing when they are too drunk to drive. My cousin used to tell me he could drive better when he was drinking because he knew he had to be more cognizant of what he was doing. I told him he would find out one day just how wrong he was, and unfortunately he did one night when he was driving home and ran his far off the road into a ditch! Fortunately he wasn’t seriously injured, but he lost his license for a year and not only paid a huge fine for the offense but also to get his license back. When I visited him after the accident, the first thing he said to me was, “Please don’t say, ‘I told you so.’”

Making the Right Choice

Driving while drunk is a poor decision on the part of any driver no matter what age. There are a number of problems a driver can encounter when making this choice up to and including the following:
  • Being the cause of an accident that usually involves death or serious injury to the driver of the car or those in another vehicle (or even innocent pedestrians)
  • Loss of your driver’s license which in some cases can also mean reduction of earning capability
  • Increase in insurance rates when you get your license back
  • High fines for both the violation itself and to get your license back later
  • In addition to injuring others in an accident you also run the potential of harming yourself if you drink and drive

No One is Exempt from the Law

Unfortunately many people seem to believe they are exempt from the drunk driving laws. This is not something they express in words but rather by their actions. A person who drinks and drives is clearly not in command of himself and in essence is telling others he believes he is more capable of driving than the law indicates he is; if he did not believe this (at least sub-consciously) he would not get behind the wheel of a car when he has obviously had too much to drink to think clearly and act rationally.

Disobeying Drunk Driving Rules are Root Cause of Many Accidents

What is drunk driving? That is a question that seems to have a simple answer but unfortunately some people have a difficult time understanding the meaning. This is especially true of teenagers who believe they are above the law or simply have the right to disobey it. Disobeying drunk driving laws has the potential to kill and maim even innocent bystanders—are you willing to live with that possibility the rest of your life?

Obeying Drunk Driving Laws

Whether you wish to believe it or not drunk driving rules are created to protect everyone on the road. In most states the law states you are legally drunk if your blood alcohol level is .08 or higher, but the problem is teens can actually show impairment in driving with a level as low as .05. Unfortunately there isn’t a way to define two sets of laws because even some adults cannot hold their alcohol and might be impaired enough to cause problems with only one glass of beer. I remember going to a party with a friend of mine who actually staggered out the door after only one small glass of wine. Why? She was an occasional drinker and she had not had anything to eat in several hours. All of these factors come into the picture and are very important in how a person reacts to alcohol in their blood. Consider some of the factors that can change how to react to alcohol.
  • Age
  • Weight
  • Medications you may be taking
  • The last time you ate and how much
  • How often you drink alcohol
  • Your current health
All of these factors and many more may affect how you react to alcohol. For more information on drinking and driving reactions see our website at Legal-Yogi .

The Vulnerability of Teens

Because of their inexperience in driving, teens are especially susceptible to the potential of a serious accident. Drunk driving teens cause more accidents than adults with the same amount of alcohol because they are still developing intellectually, and as such they do not have the same ability as adults do for being able to hold their alcohol well. You also want to add this to the fact teens don’t know when to stop drinking and tend to drink without eating, factors that contribute to a higher than normal blood alcohol level. As already stated above, a teen even at a .05 blood alcohol level doesn’t have the same level of concentration as an adult testing at the same level (or even the legal level of .08).

Having a Good Attorney is Essential

If you’re facing a conviction for drunk driving you want to choose one of the best drunk driving attorneys you can afford. Keep in mind the judge has a range of sentences he can place upon you, and with a good attorney you might find yourself facing the minimum sentence rather than the maximum. Which one would you prefer?

Researching Drunk Driving Attorneys

Understanding drunk and drive rules is essential before you think about getting behind the wheel of a car. In fact, you should know what constitutes drunk driving before you even think about having a glass of beer and driving. More importantly you need to know your own tolerance.

Understanding the Terminology

One thing you need to understand is the answer to the question: What is drunk driving? Have you ever thought about it? Most people don’t give it a second thought and even think they can drive better when they are drinking. Their irrational reasoning is because they know they have to be more careful, but the truth is when you are drinking you do not have the ability to control what you do. Your reaction time is slower and you have a tendency to become drowsy. By the time you realize what is happening it is too late to do anything about it.

Teens and Drinking: a Dangerous Combination

Have you ever thought about what would happen to your teenager if you allow him or her behind the wheel of the car with even a glass of beer? Keep in mind your teen is less experienced than older drivers and is not able to hold his or her alcohol as well as older people. These two factors make drunk driving teens real dangers on the road not only to themselves but also to other people on the road, drivers, pedestrians and passengers. Some of the risks that teens face when drinking and driving include but are not limited to the following:
  • Falling asleep at the wheel
  • Causing an accident with personal injury or property damage
  • Losing your license until at least age 21 for a DUI or DWI when underage
  • Disregard for traffic laws
  • Impaired vision, thought processes and reaction time

It’s important to keep in mind that teens are not as well-developed mentally as adults. When you add that to the lack of driving experience you’re just looking for an accident to happen. How many times have you seen in the paper about teens that had accidents without even drinking? You can expect at least double that when you add alcohol into the mix.

If you find yourself facing a conviction for drunk driving, you need to research drunk driving attorneys. It’s foolish to even think about trying to defend yourself for such a serious matter because in most cases the judge isn’t even going to think about speaking with you. A lawyer is more likely to get you a reduced sentence, especially if it’s your first offense. You shouldn’t attempt to go into court without an attorney for a drunk driving charge any more than you would for any other criminal charge, and drunk driving is indeed a criminal charge.

Effective Solutions for Drunk Driving

The problem with drunk driving is still on the increase in many states and doesn’t seem to be getting better. We need to find solutionsfor drunk driving, but without the cooperation of the courts and the drivers themselves little will be accomplished.

Teenagers are an Added Risk

As if drunk driving is not a big enough problem, we have the additional problem with drunk driving teenagers on the roads. Aside from the fact teens are not old enough to drink, we have the fact they also have limited driving experience. The combination of these two factors adds a great deal of danger, one that in all probability will hurt or even kill someone. While the laws are designed to protect others on the road, sometimes there is not enough enforcement to make those laws work for everyone.

More Programs are Necessary

While there are drunk driving programs in every state, they do not effectively solve the problem. One of the reasons this may happen is because the states do not enforce the laws on drunk driving as well as they should. Some of the things that occur to prevent effective enforcement of drunk driving laws include the following:
  • Lack of enforcement of subsequent convictions
  • Penalties that do not fit the crime (in other words leniency in sentencing when there is serious injury or death involved)
  • Individuals still having their license after several convictions of DUI or DWI
  • Failure to follow up on requirements for substance abuse programs
  • Failure of the courts to recognize many problem drivers until it is too late
For more information on the penalties for drinking and driving see Legal-Yogi.com.

Hiring an Attorney

If you have to attend court because of a DUI or DWI you may wish to hire a drunk driving attorney. While you certainly don’t have to have an attorney, it is in your best interest to have one. Having an attorney can make the difference between losing your license and being committed to a treatment program. It can also determine whether or not you will be approved for a work license so you can drive back and forth to work. An attorney is in a better position to plead your case and perhaps get you off on a lighter sentence, especially if this is your first conviction. You should never attempt to represent yourself on a charge as serious as drunk driving.

It’s important to find solutions for drunk driving, especially for drunk driving teenagers. The problem has become steadily increasing every year, and it doesn’t seem to be getting any better. In many states alcohol is responsible for over half the serious and fatal accidents, and even with drunk driving programs the problem persists. By the time many people admit they have a problem they are already in court facing the possibility of losing their licenses and depending on a drunk driving attorney to help them get a lighter sentence.
