Thoughts on the Law and DUI’s

I got in trouble when I was a young man for drinking and driving and it scared me sober for awhile. Now, nearly fifteen years later I still associate alcohol and cars with a manner of trepidation. I never ended my drinking habits altogether, and my driving record will never be perfect, but since that time I’ve become far more responsible with the two.

Adults you drive and drink
Let’s face it, adults drink alcohol, and adults also drive cars nearly every day. There is a very good chance you will drive by several people on the road that have been drinking alcohol today. The habit is that pervasive and normal, and sadly most people take their driving privileges for granted. People from every type of background however will face criminal charges of DUI this year, and the experience in court is scary, unpredictable, humbling, as well as a very tedious and time consuming affair.
  • Traffic officers are trained extensively in how to pick up signs whether a person has been drinking or not. You might think you look sober, but a cop can often tell if you’ve had even one drink.
  • Remember your rights during a traffic stop. Everything from the time a cop pulls you over to the point they decide to make an arrest is a chance for them to build evidence against you. You do have a right to refuse field sobriety tests before an arrest.
  • Find a lawyer immediately and take the time to pick their brain and ask them questions about what you might possibly face in court and from the law. The more you know, the more comfortably you will feel with the whole process. Less stress!

A risky endeavor
If you do decide you are sober enough to drive, a police officer may have something to say about that if they pull you over. Remember that many drunk driving arrests begin because of a simple traffic stop such as a broken tail light, or a minor speeding violation. There are so many things that are out of your control when you drive. There are things that can go wrong in the blink of an eye that might not even have been your fault, but because you consumed alcohol before driving you will have a lot more problems on your hands.

Protect Your Rights
A lawyer can tell you your rights before you ever get stopped for driving while intoxicated, but what good will any of this do in hindsight? The fact is that if you have been drinking and you are stopped and interrogated, you should know your rights. You should always know your rights, but remember that a police officer is trying to build a case against you after a traffic stop. Sometimes if you feel you will inevitably be arrested for your mistake than it is best to stop incriminating yourself. It is within your right to refuse field sobriety tests. You will be arrested and booked, but the evidence of a failed sobriety test will not exist.

Drunk driving solutions will inevitably always fall on the individual’s shoulders. Drunk driving programs can preach safe habits, but only you can follow through with them.
